I see what you mean. I hesitated to include them but since I included the NSO version of Wario Land 4 which came out after those stores got discontinued. I figured it wouldn't make a lot of sense. As for the private eShop replacements, like you mentioned, they are legally questionable...

I didn't account for them since they are obtained through now discontinued virtual stores. These specific versions can't be obtained legally anymore if I'm not mistaking. You'd have to buy a used console whose ex-owner already bought them.
