I generally don't play rom hacks but some catch my eyes occasionally and for those I don't have a problem.

maybe im being ignorant, but nintendo would have claimed all their content if they had a problem with it, and they definitely had the chance to take it all down.

Is that the unreasonably hard one?

I tried it out once, a long time ago. I don't remember much but the first dungeon frustrated me to no end, cuz... What was it? They didn't give you a sword or something?

they tweaked it since then, the swordless part is short and simple when i tried it.

Only if it's a fair game and you lose due to your mistakes.
And if getting a game over doesn't mean you lose progress on levels you've already completed and you arbitrarily have to play them again.

I think it's fine in games like DKC Tropical Freeze where the levels are longer and have more checkpoints to make up for the fact that you only lose your checkpoint progress when you get a game over. Games with shorter levels or no checkpoints shouldn't have them at all. In Mario 64 it just means you have to enter the castle again.
Yoshi's Woolly World thankfully removed the lives system entirely.

In Grand Theft Auto, I would drive within the speed limit of the other drivers in the game, in a safe manner, following all stop lights. I think that counts : p
